This Mobile Application End User License Agreement ("Agreement") is a binding agreement between you ("End User" or "you") and SMS Facility Management S.A.L. ("Company", "we" or "us"). This Agreement governs your use of the SAVA By SMS Mobile Application ("App").
BY DOWNLOADING/INSTALLING AND USING THE APP, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT; (B) REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT; AND (C) ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD AND USE THE APP AND DELETE IT FROM YOUR MOBILE DEVICE.
Subject to the terms of this Agreement, Company grants you a limited, non-exclusive, and non-transferable license to download, install, and use the App for your personal, non-commercial use on a single mobile device owned or otherwise controlled by you.
You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer or attempt to derive the source code; (c) remove copyright or proprietary notices; (d) rent, lease, lend, sell, sublicense, assign, distribute, or make available the App to third parties; or (e) bypass any security features.
The App is licensed, not sold. SMS Facility Management S.A.L. retains all rights, title, and interest in the App and all intellectual property rights therein.
The App requires you to create an account. You are responsible for maintaining confidentiality of your login details and for all activity conducted under your account. You may delete your account at any time in the App settings. SMS retains the right to terminate any user rights or access to the App, at any moment , without having to present any reason or without any reason at all.
By using the App, you consent to the collection and use of personal information.
The App may display or provide access to third-party content or services. SMS Facility Management S.A.L. is not responsible for the accuracy, safety, legality, or quality of such content or services.
The App acts solely as a digital intermediary to facilitate connections and services between users and independent third-party providers. SMS Facility Management S.A.L. shall not be held liable for the quality, legality, safety, timeliness, or accuracy of any services provided through the App. All interactions, agreements, payments, and services are strictly between users and providers.
To the maximum extent permitted by law, SMS Facility Management S.A.L. disclaims all liability for direct, indirect, incidental, or consequential damages arising out of your use of the App.
You agree to indemnify and hold harmless SMS Facility Management S.A.L. from any claims, damages, or legal actions resulting from your use of the App.
This Agreement shall be governed by and construed in accordance with the laws of Lebanon. Any disputes shall be subject to the exclusive jurisdiction of Lebanese courts.
By using the App, you acknowledge and agree to these terms.
اتفاقية ترخيص المستخدم النهائي لتطبيق الهاتف المحمول ("الاتفاقية") هي اتفاقية ملزمة بينك ("المستخدم النهائي" أو "أنت") وبين شركة SMS Facility Management S.A.L. ("الشركة"، "نحن"). وتُحكِم هذه الاتفاقية استخدامك لتطبيق SAVA By SMS ("التطبيق").
بتنزيل أو تثبيت أو استخدام التطبيق، فإنك:
تقرّ بأنك قد قرأت هذه الاتفاقية وفهمتها؛
تؤكد أنك تبلغ السنّ القانوني لإبرام اتفاقية ملزمة؛
تقبل هذه الاتفاقية وتوافق على الالتزام قانوناً بجميع أحكامها.
إذا لم توافق على هذه الشروط، فلا تقم بتنزيل التطبيق أو استخدامه، وقم بحذفه من جهازك المحمول.
تمنحك الشركة ترخيصاً محدوداً، غير حصري، وغير قابل للتحويل، لتنزيل وتثبيت واستخدام التطبيق للاستخدام الشخصي وغير التجاري فقط، على جهاز محمول واحد مملوك لك أو خاضع لسيطرتك.
لا يجوز لك، بأي حال من الأحوال:
أ. نسخ أو تعديل أو إنشاء أعمال مشتقة من التطبيق؛
ب. إجراء هندسة عكسية أو محاولة استنتاج الكود المصدري للتطبيق؛
ج. إزالة أو تعديل أي إشعارات خاصة بحقوق الطبع والنشر أو الملكية الفكرية؛
د. تأجير أو بيع أو ترخيص فرعي أو توزيع التطبيق على أي طرف ثالث؛
هـ. محاولة تجاوز أي إجراءات أو خصائص أمنية ضمن التطبيق.
التطبيق مُرخّص لك، وليس مباعاً. وتحتفظ شركة SMS Facility Management S.A.L. بجميع الحقوق وملكية التطبيق وجميع حقوق الملكية الفكرية المتعلقة به.
قد تتطلب بعض ميزات التطبيق إنشاء حساب مستخدم. وتكون مسؤولاً بشكل كامل عن الحفاظ على سرية بيانات تسجيل الدخول الخاصة بك وعن جميع الأنشطة التي تتم من خلال حسابك. يحق لك حذف حسابك في أي وقت عبر إعدادات التطبيق. كما تحتفظ شركة SMS بالحق في إنهاء أي حقوق أو تقييد وصول أي مستخدم إلى التطبيق، في أي وقت، دون الحاجة إلى تقديم سبب أو حتى من دون سبب على الإطلاق.
باستخدامك للتطبيق، فإنك توافق على جمع واستخدام المعلومات الشخصية.
قد يعرض التطبيق أو يوفّر وصولاً إلى محتوى أو خدمات خاصة بأطراف ثالثة. ولا تتحمل شركة SMS Facility Management S.A.L. أي مسؤولية عن دقة أو قانونية أو سلامة أو جودة هذه الخدمات.
يعمل التطبيق فقط كوسيط رقمي لتسهيل تقديم الخدمات بين المستخدمين ومقدّمي الخدمات المستقلين من الأطراف الثالثة. ولا تتحمل شركة SMS Facility Management S.A.L. أي مسؤولية عن جودة أو قانونية أو سلامة أو دقة أي خدمات يتم تقديمها عبر التطبيق. وتبقى جميع التفاعلات والاتفاقيات والمدفوعات والخدمات حصراً بين المستخدمين والموردين.
إلى أقصى حد يسمح به القانون، تخلي شركة SMS Facility Management S.A.L. مسؤوليتها عن أي أضرار مباشرة أو غير مباشرة أو عرضية أو تبعية ناجمة عن استخدامك للتطبيق.
توافق على تعويض وإعفاء شركة SMS Facility Management S.A.L. من أي دعاوى أو أضرار أو إجراءات قانونية تنشأ عن استخدامك للتطبيق أو عن أي خرق لشروط هذه الاتفاقية.
تخضع هذه الاتفاقية وتُفسَّر وفقاً لقوانين الجمهورية اللبنانية. وتكون المحاكم اللبنانية صاحبة الاختصاص الحصري في الفصل بأي نزاعات تنشأ عن هذه الاتفاقية.
باستخدامك للتطبيق، فإنك تقر وتوافق صراحةً على جميع الشروط والأحكام الواردة أعلاه.
