This Mobile Application End User License Agreement ("Agreement") is a binding agreement between you ("End User" or "you") and SMS Facility Management S.A.L. ("Company", "we" or "us"). This Agreement governs your use of the SMS Community Mobile Application ("App").

BY DOWNLOADING/INSTALLING AND USING THE APP, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT; (B) REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT; AND (C) ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD AND USE THE APP AND DELETE IT FROM YOUR MOBILE DEVICE.

• License Grant: Subject to the terms of this Agreement, Company grants you a limited, non-exclusive, and non-transferable license to download, install, and use the App for your personal, non-commercial use on a single mobile device owned or otherwise controlled by you.
• License Restrictions: You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer or attempt to derive the source code; (c) remove copyright or proprietary notices; (d) rent, lease, lend, sell, sublicense, assign, distribute, or make available the App to third parties; or (e) bypass any security features.
• Reservation of Rights: The App is licensed, not sold. SMS Facility Management S.A.L. retains all rights, title, and interest in the App and all intellectual property rights therein.
• Accounts and Access: The App requires you to create an account. You are responsible for maintaining confidentiality of your login details and for all activity conducted under your account. You may delete your account at any time in the App settings. SMS retains the right to terminate any user rights or access to the App, at any moment, without having to present any reason or without any reason at all.
• Collection and Use of Personal Information: By using the App, you consent to the collection and use of personal information.
• Third-Party Services: The App may display or provide access to third-party content or services. SMS Facility Management S.A.L. is not responsible for the accuracy, safety, legality, or quality of such content or services.
• Disclaimer of Liability: The App acts solely as a digital intermediary to facilitate connections and services between users and independent third-party providers. SMS Facility Management S.A.L. shall not be held liable for the quality, legality, safety, timeliness, or accuracy of any services provided through the App. All interactions, agreements, payments, and services are strictly between users and providers.
• Limitation of Liability: To the maximum extent permitted by law, SMS Facility Management S.A.L. disclaims all liability for direct, indirect, incidental, or consequential damages arising out of your use of the App.
• Indemnification: You agree to indemnify and hold harmless SMS Facility Management S.A.L. from any claims, damages, or legal actions resulting from your use of the App.
• Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Lebanon. Any disputes shall be subject to the exclusive jurisdiction of Lebanese courts.

By using the App, you acknowledge and agree to these terms.
